SECTION 1 :  ORGANIZING COMPANY

The company  SARL Madame Mo having its registered office at 40 Chemin du Centre, 64160 Saint Armou France, registered in the Pau Trade and Companies Register under number 453 227 134 (hereinafter the « Organizing Company ») organizes a contest called « Le GRAND Show »/ « The BIG show» (hereinafter the « Contest »).

SECTION 2 : THE PARTICIPANTS

Le Contest is open to anyone over age eighteen (18). The participants under 18 must must have obtained the prior specific agreement of his or her parent or legal representative. The Organizing Company reserves the right to verify this agreement and to to invalidate all participation without such prior agreement.

SECTION 3 : HOW TO PARTICIPATE

3.1 Address of the Contest

The Contest is available only on the website of the Organizing Company at the following address  : http://www.madamemo.com/concours

The participant connects or registers on the website of the contest at the above address. The subscription implies the acceptance of the present rules.

3.2 Conduct

Each week, throughout the duration of the Contest (01.01.2012 to 31.12.2012), the Organizing Company will broadcast one of the 52  (fifty­-two) cartoons from the Intermèdes de Madame Mo 1&2 on its web site. Every week, the participants will answer one question about the broadcasted cartoon of that week.
Every week, the Organizing Company shall inform the participants by e-mail about the broadcasting of the new cartoon.
The questions of the previous weeks shall remain available and answers may be modified by the Participant throughout the duration of the Contest. Every cartoon will be broadcast on the website during one week.
The object of this Contest is to answer all the questions correctly.
In agreement with SECTION 4, there will be a random draw conducted by the Organizing Company amongst all eligible Prize claimants to award the main winner.

3.3 Limit of entries per person

Limit of one (1) entry per person.

3.4 submissions not taken into account

All submissions shall be subject to the overview of a moderator.

As a result of this moderating procedure, the Organizing Company, at its sole discretion, retains the right to not take into account submissions
- with information concerning the identity or address of the Participant that are incomplete, false, usurped or made in contravention of the present rules ;
- that are submitted after Dec. 31, 2012 at midnight ;
- that are made in contravention of the present rule ;
- that violate the rights of any third parties.
The Organizing Company shall not be responsible for any loss alteration or illegal use of any submission.

3.5 The Contest is completely free of charges with no obligation to buy

Participants shall not be charged any registration fees and/or other fees pertaining to the participation of this contest.

SECTION 4 : DETERMINATION OF THE WINNER

Among the different Submissions, those Submissions containing only correct answers shall be pre-selected by the Organizing Company. Among these preselected Submissions, one winning Submission will be drawn at random.
The result of this decision by lot will be no subject to appeal or review. The Organizing Company shall also decide in a sovereign manner and in  respect of the law, all question of application and/or interpretation of the present Contest Rules as well as every question not taken into account by the latter which might appear concerning the present Contest.

SECTION 5 : PRIZE

The (1) Winner shall receive 6 unique pieces of Art : 6 (six) dolls from the world of Madame Mo representing him-/herself as well as five (5) people of his/her choice. These dolls will be designed exclusively for this occasion by the Artiste Pascale Moteki, designer of the world of Madame Mo. For that purpose, the Winner shall submit to the Company Madame Mo pictures of him/herself as well as of the five (5) people of his/her choice that he wishes to be represented. The estimated  value of this prize is 600 Euro (six hundred Euro).

These dolls shall be photographed by the Organizing Company and published on the website  madamemo.com and sent by e-mail to all Participants and all business partners of the Organizing Company.

The prizes awarded may not give rise to any dispute of any kind, nor to the award of their equivalent value in money or in any further form, nor to their replacement or exchange for whatever reason (except for deterioration of the prize duly recorded by the Organizing Company). However, the Organizing Company does not assume any liability for damages caused by the Winner or by the postal services.

The Organizing Company cannot be held responsible for any error due to incorrect address details provided, making it impossible to deliver the prize.

The Organizing Company retains the right to decide to replace any prize, in full or in part, and to make a prize substitution of equivalent value (in the case of an external problem to obtain the initially foreseen prize, especially in case of a temporary supply disruption or impossibility to realize the piece of Art in the conditions announced.
The prizes shall not be sold by the Winner to an independent buyer.
The company Madame Mo owns all intellectual property related to the prizes. The latter reserves the right to use the prizes in its communication and for promoting its trademark in France and abroad.
In return, the Winner shall not use the prize or a representation hereof outside the private and domestic sphere. Any use of the Madame Mo characters with any commercial or promotional purposes should be liable to prosecution.

SECTION 6 : PUBLISHING OF THE RESULTS

The Winner or his/her parent will be notified by email, or telephone to the email address and/or telephone number provided by the Winner upon registration as a Participant in the Contest.

SECTION 7 : INTELLECTUAL PROPERTY

In accordance with the law, the participants guarantee that the pictures provided for the design of the dolls do not infringe the rights of any third party.

SECTION 8 : PERSONAL DATA AND PRIVACY PROTECTION

The Winner whose representation as a Madame Mo doll is published, and his/her parent or legal representative for Participants under 18, accept the fact that the Organizing Company retains the right without financial compensation to use the first name and the first letter of his/her surname as well as his/her age and hometown (such as provided in the contest subscription form http://www.madamemo.com/concours) to release the name of the Winner of the Contest.

Any personal information provided in the contest subscription form on http://www.madamemo.com/concours shall be used to notify the Winner as well as for the manufacturing and the presentation of the Prize.

Every Participant shall have the right of access to his personal data and the right to rectify any such data or to withdraw his/her personal data by submitting a written notice to the following address : SARL Madame Mo, 40 Chemin du Centre, 64160 Saint Armou, France.

SECTION 9 : LIMITATION OF LIABILITY

9.1 Force Majeure. The liability of the Organizing Company shall not be engaged if, on account of an event of force majeure or any event which is outside of its control, the Game has to be modified, delayed, cut short or cancelled.

9.2 Duration of the Contest. The Organizing Company reserves the right in all circumstances to extend the period for participation and to postpone any announced date.

9.3 Limitation concerning the Internet. The Organizing Company undertakes to maintain its website under normal operating conditions 24 hours a day.

However, the participation in the Contest means that the Participant knows and agrees the specifications and limitations of Internet, more particularly concerning the performances, the response time for consulting, processing or transferring information, the risks of interruption, and more generally the risks inherent to any connection to and transmission via the internet, the lack of protection available for certain data against possible misuse and the risks of contamination by any viruses affecting the network. .

Consequently, the Organizing Company shall not be held liable in any circumstances for the non-exhaustive list following:
-    the transmission and/or of the receipt of any data and/or information on the internet;
-    any malfunction of the internet network preventing the proper organization/functioning of the Contest;
-    a default in any receiving equipment or lines of communication;
-    the loss of any paper mail or electronic mail, and, more generally, the loss of any data;
-    transmission problems;
-    the functioning of any software;
-    the consequences of any virus, computer bug, anomaly or technical defect;
any damage caused to the computer of a Participant;
a technical, hardware or software defect of any nature whatsoever which may prevent or limit participation in the Game or which may damage the computer system of a Participant.

It shall be incumbent on all Participants to take all appropriate steps to protect their own data and/or software stored or saved on their computer equipment against any problem. The connection to the Website http://www.madamemo.com/concours and the participation of any person shall be subject to their liability alone.

SECTION 10 : ACCEPTANCE OF THESE TERMS

The fact of participating to this contest entails unqualified acceptance of the present rules.

The Organizing Company retains the right to take legal action against anyone who should commit fraud or attempted fraud. The company Madame Mo may on no account be held responsible in case of any fraud eventually committed.

Should a Participant breach the Rules, the Organizing Company reserves the right to disregard the participation of such Participant, without such Participant having any right of action or compensation whatsoever as a result thereof.


SECTION 12 : LAW AND JURISDICTION

The Participants agree that present Rules are subject to French law and the courts of Pau (France) assign exclusive jurisdiction over any action or claim related to the present Rules of the Contest,  provided that nothing herein shall prevent the implementing and execution of any applicable mandatory laws.
